1. Acceptance of Terms

By accessing or using SubscriberLink ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the Service, including creators who host content and fans who subscribe to creators.

2. Description of Service

SubscriberLink is a multi-tenant platform that provides content creators with branded websites for fan engagement. Our Service includes:

• Custom branded websites for creators
• Fan subscription management
• Direct messaging between creators and fans
• Content hosting and distribution
• Payment processing via Stripe
• Analytics and engagement tracking

3. User Accounts

3.1 Creator Accounts

To create content on SubscriberLink, you must register for a creator account. You must provide accurate, current, and complete information during registration and keep your account information updated.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Fan Accounts

Fans may create accounts to subscribe to creators and access content. Fan authentication is handled via one-time password (OTP) sent to your email address.

You must be at least 18 years old to create an account on SubscriberLink.

4. Subscription Tiers

SubscriberLink offers the following subscription tiers:

• Free Tier: Basic access with limited messaging capabilities
• Premium Tier: Enhanced access with increased messaging limits
• PremiumPlus Tier: Unlimited messaging and priority support

Subscription prices are set by individual creators within platform guidelines. Prices may vary between creators.

5. Payment Terms

5.1 Platform Fee

SubscriberLink charges a 1% platform fee on all transactions. Additionally, standard payment processing fees from Stripe (approximately 2.9% + $0.30 per transaction) apply and are passed through at cost.

5.2 Payment Processing

All payments are processed through Stripe. By using SubscriberLink, you also agree to Stripe's Terms of Service.

Creators receive payments directly to their connected Stripe accounts via Stripe Connect. Funds are transferred directly to creators minus the platform and processing fees.

5.3 Subscriptions

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time, but access will continue until the end of the current billing period.

6. Content Guidelines

6.1 Creator Responsibility

Creators are solely responsible for the content they post on SubscriberLink. By posting content, you represent and warrant that:

• You own or have the necessary rights to the content
• The content does not infringe any third-party intellectual property rights
• The content complies with all applicable laws and regulations
• All individuals depicted in content have given their consent and are of legal age

6.2 Prohibited Content

The following content is strictly prohibited on SubscriberLink:

• Content depicting minors in any context
• Non-consensual content
• Content promoting violence, terrorism, or hate speech
• Content that violates any applicable laws
• Content that infringes intellectual property rights
• Fraudulent or misleading content
• Malware or harmful code

We reserve the right to remove any content that violates these guidelines and to terminate accounts of repeat offenders.

7. Intellectual Property

7.1 Creator Content

Creators retain all ownership rights to their content. By posting content on SubscriberLink, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content through our Service.

7.2 Platform Content

The SubscriberLink platform, including its design, features, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of our platform without permission.

8. Termination

We may terminate or suspend your account at any time if:

• You violate these Terms
• You post prohibited content
• Your account is involved in fraudulent activity
• We are required to do so by law

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

If your account is terminated, any active subscriptions will be cancelled and no refunds will be issued for the remaining subscription period.

9. Disclaimers and Limitation of Liability

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 User Content

WE DO NOT ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY CONTENT POSTED BY USERS. YOU ACCESS AND USE USER CONTENT AT YOUR OWN RISK.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUBSCRIBERLINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
