DMCA Policy

1. Our Commitment to Copyright Protection
SubscriberLink respects the intellectual property rights of others and expects our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to legitimate notices of alleged copyright infringement.
We have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers.
2. Reporting Copyright Infringement
If you believe that content on SubscriberLink infringes your copyright, please send a DMCA takedown notice to our designated agent with the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing, including the URL or other specific location where the material is found
- Your contact information, including your name, address, telephone number, and email address
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner
3. Counter-Notification Process
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with the following information:
- Your physical or electronic signature
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which SubscriberLink may be found
- A statement that you will accept service of process from the person who provided the original notification or an agent of such person
Upon receipt of a valid counter-notification, we will forward it to the complaining party. If the original complainant does not file a court action against you within 10-14 business days, we may restore the removed content.
4. Repeat Infringer Policy
In accordance with the DMCA, we will terminate the accounts of users who are repeat infringers. A repeat infringer is a user who:
- Has been the subject of more than two valid DMCA takedown notices
- Has had content removed multiple times due to infringement
- Continues to upload infringing content after receiving warnings
We reserve the right to terminate accounts at our discretion, even after a single infringement in egregious cases.
5. Good Faith Requirement
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability.
Before filing a DMCA notice, please ensure that you are the copyright owner or authorized to act on their behalf, and that the use of the material is not fair use.
6. Creator Responsibilities
As a creator on SubscriberLink, you are responsible for ensuring that you have the necessary rights to all content you upload. This includes:
- Original content that you created yourself
- Content for which you have obtained a license or permission
- Content that is in the public domain
- Content that falls under fair use (consult legal counsel if unsure)
If you are unsure whether you have the rights to use certain content, do not upload it to SubscriberLink.
